By signing your name as a participant of an adventure, tour, experience, event, route, etc. of WANATOURPR (herein WTPR), you acknowledge that the tours could expose you to the possibility of a personal injury due to the type of terrain and physical activities involved during the experience. You also acknowledge that WTPR is not responsible for any loss, theft, damage or personal injury that occurs during a particular tour or activity and therefore you assume personal responsibility for your decisions, actions and consequences during the course of any activity related to such experience, adventure, tour, event, route, etc. As a participant, you accept full responsibility for your behavior, well being, and health throughout the experience, adventure, tour, event, route, etc., which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: hiking, some climbing, running, or walking for a longer period than you used to. You further realize that the tour may involve walking through unfamiliar, narrow, cave interiors, unpaved and/or steep paths, gangways, trails, unpaved roads, rustic trails, rocky trails, uneven terrains, etc. You, knowingly and willfully, accept these risks and take complete and total responsibility for your behavior, well being and health during the tour or event. You agree to hold neither WTPR, its tour guides, agents, liable in any way should any harm come to you. By purchasing the event, you affirm that have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.
Therefore, by understanding this waver, I release WTPR, its tour guides, its agents, licenses and consultants from any liability or other claims arising from or in connection with my participation in the tour, including claims that are known or unknown, foreseen and unforeseen. So WTPR, is not responsible for any accidents or injuries that result from the experience. I, the undersigned, agree to this release of all claims, waiver of liability and assumption of risk. I waive any and all claims I may have now and in the future, and release from all liability and agree not to sue WTPR, its officers, agents, representatives, employees or tour guides for any personal injury, death, property damage, or loss sustained by me as a result of my participation in a tour or experience offered by WTPR, or tour partners. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action. I am aware that the tours and events offered, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather conditions subject to sudden and unexpected change. I accept all the inherent risks of the proposed tour and the possibility of personal injury, death or property damage or loss resulting there from. I acknowledge that the enjoyment and excitement of the proposed form of tour or event is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness WTPR or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour. In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements or any other inducement or coercion to go on the tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this experience or event and Wavier and Release and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors.
This document also grants permission to the rights of any images, videos or recordings taken of me, without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product where my image may appear. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in Social Media or in the internet within an unrestricted geographic area. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.
By signing this document I acknowledge that I have completely read and fully understand the above release and agree to be bound to its terms. I hereby release all claims against WTPR, or any person utilizing this material.
